KLAUSELN 

 

Die Formalisierung von Reservierungen über die Website unterliegt den folgenden Klauseln:

1. Erklärungen: Der Kunde erklärt:

Der Kunde akzeptiert, dass das HOTEL keine Verpflichtung oder Verantwortung für die Dienstleistungen übernimmt, die es nicht direkt erbringt, insbesondere für die mangelnde Richtigkeit, Unvollständigkeit, mangelnde Aktualisierung und/oder Ungenauigkeit der Daten oder Informationen über Angebote, Preise, Eigenschaften und alle anderen relevanten Daten und Informationen über Produkte oder Dienstleistungen externer Anbieter, die über die Website beworben werden oder reserviert werden können. Ebenso ist das HOTEL von jeglicher Haftung befreit, die sich aus der Nichteinhaltung oder mangelhaften Einhaltung der sich aus dem Vertragsverhältnis ergebenden Pflichten oder der geltenden Vorschriften durch diese Lieferanten ergibt. 

 

 

3.3. Online-Reservierungen: Der Prozess der Formalisierung von Online-Reservierungen erfolgt in folgenden Schritten:

Schritt 2. Bedingungen: Akzeptanz der rechtlichen Bedingungen. 

Schritt 3. Persönliche Angaben. 

Schritt 4. Bestätigung und Zahlung. 

Sobald die Reservierung erfolgt ist, wird eine Bestätigung per E-Mail an die vom Kunden angegebene Kontaktadresse gesendet. 

Sofern in den Tarifbedingungen nicht anders angegeben, gilt die Reservierung erst dann als verbindlich, wenn eine Anzahlung in Höhe einer Nacht geleistet wurde. 

3.4. Reservierungen auf Anfrage: Für Dienstleistungen, die nur auf Anfrage reserviert werden können, sofern in den Tarifbedingungen nichts anderes vorgesehen ist, bedeutet die bloße Anfrage nach Verfügbarkeit nicht den Abschluss der Reservierung, die der Einhaltung unterliegt Anforderungen, die auf der Seite angegeben sind, von der aus Sie Ihre Anfrage stellen, sowie deren wirksame Bestätigung durch das HOTEL. 

3.5. Bei jedem Schritt der Reservierung können etwaige Fehler bei der Dateneingabe über die Schaltfläche „Zurück“ in Ihrem Browser korrigiert werden. Ebenso werden die Reservierungsdetails in der Bestätigungs-E-Mail zusammengefasst. Sollten Fehler festgestellt werden, muss der Nutzer unverzüglich die entsprechenden Korrekturen beim HOTEL anfordern, indem er eine E-Mail an die in der Kopfleiste dieses Dokuments angegebene E-Mail-Adresse sendet. 

4. Preis und Bezahlung: 

4.1. Die Bedingungen, der Preis der Dienstleistungen und die akzeptierten Zahlungsmethoden sind diejenigen, die ausdrücklich auf der Seite festgelegt sind, auf der Sie die Reservierung vornehmen. 

Der Kunde ermächtigt dem HOTEL ausdrücklich, die in den Tarifbedingungen vorgesehenen Gebühren zu erheben, beispielsweise um eventuelle Strafen bei verspäteter Stornierung oder Nichterscheinen zu zahlen, und akzeptiert, dass die angegebenen Zahlungsmethodendaten zur Durchführung der entsprechenden Gebühren verwendet werden. 

4.2. Aktionen und Angebote sind nur so lange gültig, solange sie für die Leistungsempfänger zugänglich bleiben. 

4.3. Sofern nicht ausdrücklich und anders angegeben, handelt es sich bei den auf der Website angegebenen Tarife um Einzelhandelspreise inklusive Mehrwertsteuer. Die Transaktion wird unabhängig von der Herkunft des Kunden in EURO durchgeführt. 

5. Änderung oder Stornierung von Reservierungen: Sofern in den Tarifbedingungen auf der Seite, auf der die Reservierung beantragt oder formalisiert wird, nichts anderes angegeben ist, gelten die folgenden Bedingungen: 

Der Kunde muss den vollen Preis der Reservierung bezahlen, sofern er zu irgendeinem Zeitpunkt storniert. 

Der Kunde muss jederzeit den Gesamtpreis der Reservierung im Voraus bezahlen. 

Flexible - 3 días

Der Kunde kann die Reservierung bis zu 3 Tage vor dem Ankunftsdatum kostenlos stornieren. 

Der Kunde muss den Preis der ersten Nacht bezahlen, wenn er innerhalb von 2 Tagen vor dem Ankunftsdatum storniert. 

Der Kunde muss nach der Reservierung den Preis für die erste Nacht im Voraus bezahlen. 

Weitere Einzelheiten finden Sie in den ausgeschriebenen Bedingungen, die in der Beschreibung während des Reservierungsvorgangs ausgewählten Tarifs angegeben sind. 

6. Widerrufsrecht: Im Sinne der Bestimmungen von Artikel 97.1.i) RDL 1/2007 werden Sie darüber informiert, dass Sie gemäß den Bestimmungen von Artikel 103 l) des oben genannten Königlichen Gesetzesdekrets kein Widerrufsrecht haben Rückzug. Unterlassung.

Unbeschadet der Rechte, die den Verbrauchern in Fragen der Gerichtsbarkeit durch das Königliche Gesetzesdekret 1/2007 vom 16. 2. What will we process or communicate your data for and on what legal basis?

 

Processing and management of reservations: We process the identification and contact details of the reservation holder in order to process the reservation and prepare your stay at our hotel. This processing is necessary for the execution of the contract or for the application of pre-contractual measures requested by the customer. In the event that you process your booking through an agency or tour operator, the data are provided by this intermediary.

Check-in process and data processing during your stay: In compliance with the Convention implementing the Schengen Agreement and Organic Law 4/2015 of 30 March 2015 on the protection of public safety, we are obliged to record the information of all guests staying at our hotels. This information, which is recorded in an entry form and serves to establish a travellers' log book, consists of the following data: Name and surname, sex, date of birth, country of nationality, number and type of identity document, date of issue of the document, date of entry and signature. 

The data processed to pre-fill the report are obtained from the check-in form and/or from the image of the passport or ID card that you have provided for this purpose. This image is processed by a character recognition program (OCR) to extract the information necessary for the report and is deleted as soon as the process has been completed.

Likewise, the photo that appears on the passport or ID card that you have provided for check-in will be registered in the hotel's management system. The purpose is to allow the hotel staff to identify our guests staying at the hotel and to simplify the access to services and the process of charging the consumption made to your room. Access to your image is restricted to hotel staff and will be deleted at the time of check-out. This treatment is based on the consent requested during the check-in process, alternatively you can prove your status as a guest by means of your passport or ID card.

Management of the stay in our establishment: We process the identification data and data relating to your stay, requests and consumption made in our establishment to attend to you, based on the contracted services.

Invoicing of services: We process the identification data of the holder of the reservation or contracting of services, to invoice the services provided and the charges that may have been generated during the stay, based on the established contractual relationship and our obligations in accounting and tax matters.

Statistical and quality management purposes: In the event of making a suggestion or complaint at the hotel providing data that allows you to be identified, these will be processed for statistical purposes and to improve the quality of the hotel's services, and, if you have consented, the identification data and contact data provided by users of the hotel's Wi-Fi network access platform will be processed to send them satisfaction surveys for the same purposes. Likewise, in order to evaluate and manage the quality of our services and products, we carry out statistics based on web browsing data, e.g. IP address, weblogs, pages visited or actions carried out on the website (+ info. in our cookies policy available at www.hotel-bahia-del-sol.com).

These processing operations are based on our legitimate interest in evaluating and managing the quality of our services and products. For the weighting of this interest with respect to their rights and freedoms, it has been determined that the processing had a limited impact on the privacy of data subjects, as it corresponds to their reasonable expectations and did not pose significant threats as it was carried out on aggregated data and with the consent of the data subjects themselves with respect to the metrics used with the use of cookies. 

Sending of commercial communications: We process the identification and contact data provided by our customers, users registered on the hotel's Wi-Fi access platform and people who register on our distribution lists in order to send them commercial communications relating to our tourist establishment and the services we offer therein. Not providing such consent or withdrawing it does not in any way affect the provision of the contracted services or the lawfulness of the processing carried out on the basis of consent given prior to its withdrawal.

 

3. To whom may we disclose your data?

 

We will only disclose your data if we are legally obliged to do so or if it is necessary for the provision of the requested services. For example, in the event that your reservation contains ancillary services provided by third party suppliers or the availability request you make is related to these services, the personal data necessary for the processing of such reservation/availability request will be communicated to the corresponding suppliers, only for this purpose. 

Likewise, information about your stay will be communicated to the authorities or security forces in accordance with current regulations on security and control of travellers.

 

4. How long do we keep our data? 

 

The data of the passengers included in the book-registration of journeys will be kept for three years, depending on the date of the last record of the hojas which they include. 

Customer data will be retained on a fiscal basis. 

Data processed for commercial purposes will be kept for as long as their deletion is not requested. The media on which your consent to the processing of your data for these purposes is recorded, such as signed forms or logs of the sending of forms, will be kept for the duration of the processing and the applicable statute of limitations.
